Einräumung von Nutzungsrechten
Dem „Verein zur Förderung der Klassischen Musik e.V.” – nachfolgend „Verein“ genannt – werden an dem zur Verfügung gestellten Material nicht-exklusive, weiter lizenzierbare, zeitlich und räumlich unbeschränkte Rechte eingeräumt, dieses zu Zwecken der Pressearbeit und der Bewerbung des OPUS KLASSIK für folgende Nutzungsarten zu nutzen: Öffentliche Zugänglichmachung über Websites und Social Media, Veröffentlichung, Vervielfältigung und Verbreitung in Printmedien, Ausstrahlung im Rundfunk (Senderechte jeder Art), Bearbeitungsrechte, soweit redaktionell und technisch erforderlich, Archivierungs- und Datenbankrechte.
Garantien
Mit Hochladen des Materials wird garantiert, dass das Material frei von Rechten Dritter ist und der Verein von sämtlichen Ansprüchen Dritter auf erstes Anfordern freigestellt wird, die Dritte trotz dieser Garantie gegen den Verein geltend machen. Gleiches gilt für angemessene Rechtsverfolgungskosten.
Des weiteren wird versichert, dass abgebildete Personen mit der Verwendung im o.a. Zusammenhang und der Verarbeitung der personenbezogenen Daten durch den Verein einverstanden sind und auf die Datenschutzinformationen hingewiesen wurden.
Granting of rights of use
The “Verein zur Förderung der Klassischen Musik e.V.” (Association for the Promotion of Classical Music) – hereinafter referred to as the “Association” – is granted non-exclusive, further licensable, temporally and spatially unrestricted rights to use the provided material for purposes of press relations and promotion of OPUS KLASSIK for the following types of use: Public access via websites and social media, publication, reproduction and distribution in print media, broadcasting on radio (broadcasting rights of any kind), editing rights as far as editorially and technically necessary, archiving and database rights.
Guarantees
By uploading the material, the user guarantees that the material is free of third party rights and that the association will be released from all third party claims on first demand, which third parties assert against the association despite this guarantee. The same applies to reasonable legal costs.
Furthermore, it is assured that persons depicted agree to the use in the above context and the processing of personal data by the association and have been made aware of the data protection information.
